Public liability claims in Queensland
Injured because of someone else's carelessness at a shop, venue, footpath or property.
When you may have a claim
Businesses, councils and property owners must take reasonable care to keep people safe. If you were injured because they didn't, for example a slippery floor, a broken footpath or unsafe equipment, you may be able to claim compensation.
In Queensland these claims follow the Personal Injuries Proceedings Act, which sets out steps to take before court proceedings can start, beginning with a Notice of Claim.
Evidence matters
Photos of where it happened, the names of witnesses, any incident report and your medical records all help show what happened and how it has affected you.
What to do now
- See a doctor and keep a record of your treatment and expenses.
- Take photos of where it happened, and of your injuries.
- Report the incident to the business, council or owner and ask for a copy of the report.
- Write down the names and phone numbers of any witnesses.
- Get advice before the Notice of Claim time limit runs out.
