Motor vehicle accident claims in Queensland

How compulsory third party (CTP) insurance works if you're injured on the road.

Who pays

Every Queensland registered vehicle has compulsory third party (CTP) insurance. If another driver was wholly or partly at fault, their CTP insurer may pay compensation for your injuries, including treatment costs, lost income and pain and suffering.

If the vehicle was unregistered or can't be identified, the claim is made against the Nominal Defendant. Much shorter time limits apply to unidentified vehicles, so act quickly.

CTP covers injuries, not damage to vehicles or other property.

Being partly at fault

You may still be able to claim if you were partly at fault, although compensation can be reduced. Passengers, cyclists and pedestrians can claim too.

What to do now

  1. Report the accident to police if it hasn't been reported.
  2. See a doctor and keep a record of your treatment and expenses.
  3. Write down what happened, and the details of the other vehicle, driver and any witnesses.
  4. Lodge a Notice of Accident Claim Form with the CTP insurer.
  5. Don't sign a settlement or release without advice.
